Rules of "Marco" loyalty program for regular buyers of "Marco" retail chain stores
(Hereinafter - Rules)
1. General provisions:
1.1. These Rules define the terms and conditions of participation in the Loyalty Program for permanent buyers of the "Marco" trading network stores (hereinafter referred to as the Program). The Participant enters into relations with the Operator from the moment of registration in the Program, fully and unconditionally accepts these Rules, undertakes to fulfill them and entitled to receive Privileges in accordance with these Rules. The Rules are posted on the Program Website as well as in other sources at the Operator 's discretion.
1.2. The program is valid on the territory of the Republic of Kazakhstan in the "Marco" trade network stores (hereinafter - "Marco" stores). The full list of addresses of "Marco" Stores is available on the Program Website (www.marco.kz).
1.3. The Program is valid from the moment of its start until its complete cancellation by the Operator 's decision.
2. Terms and definitions:
Program - is the relationship in which the Participant purchasing goods and/or services from the Operator using the Participant Card of any type provided in the Rules acquires the right to receive Privileges in accordance with these Rules.
Questionnaire - is the information about the Customer wishing to become a Participant of the Program, entered by the Customer or reported by the Customer at registration in the Program in accordance with the procedure stipulated by the Rules.
Customer means a person who is the holder of the Card but has not registered with the Program in accordance with the Rules.
Participant - is the individual who has reached the age of 16 years, registered in the Program in accordance with these Rules and he/she is the holder of the Participant 's Card. The Participant shall have the right to manage his/her Point Account independently (accumulate/debit Points).
Privileges - is the possibility to purchase goods and/or services from the Operator with financial or non-financial benefit. Privileges may be granted by means of deferred discount - Points earning in the Participant 's Account for purchase of goods and/or services from the Operator and/or third parties (if provided in the Program Rules) and subsequent spending of accumulated Points by the Participant when he/she purchases goods and/or services from the Operator in accordance with the Rules.
Points - is the settlement units credited to the Participant 's Point Account for the purchase of goods and/or services from the Operator in accordance with the Rules, as well as if the Participants meet other conditions defined by the Operator themselves, which are the basis for Points earning.
The amount of Points accrued may be used by the Member to receive a discount upon its purchase of goods and/or services from the Operator, as well as to obtain other Privileges.
Express Points – are the Points with a limited validity period awarded to Participants within the framework of special promotions conducted by the Operator.
Point Account (also Account) means the account opened by the Operator in its information system in the name of the Participant at the moment of registration in the Program in accordance with these Rules. The account is maintained in Points. Points shall be awarded to the Account and debited from the Account upon purchase of goods and/or services from the Operator using any type of Member Card in accordance with the Rules. The account is linked to the Member 's mobile phone number. Only one Account can be linked to one mobile number in the Program.
The Participant Card (hereinafter referred to as the Card) is a card having a unique number which in accordance with these Rules serves to identify the Participant in the Program when the relevant Participant purchases goods and/or services from the Operator. The card allows you to accumulate and charge Points.
The Program includes the following types of Cards: Bonus Card
Bonus card - is the plastic card sold/issued by Operator in "Marco" stores in accordance with the Program Rules;
3. Registration in the Program:
3.1 Participation in the Program is voluntary. Any individual who has reached the age of 16 (Sixteen) at the time of registration in the Program may become a Participant.
3.2 You should obtain a Card and register for the Program in accordance with these Rules to participate in the Program.
3.3 You can obtain the Card in one of the following ways:
3.3.1 Purchase a Bonus Card at the cash register at the Marco Store, paying an entrance fee of the amount set by the Operator on the date of purchase of the Card when purchasing the Card. The Operator reserves the right to unilaterally decide to change the amount of the entrance fee and the list of "Marco" stores where the Card may be purchased and entrance fee paid.
3.4. In order to be able to charge Points when making purchases of goods and/or services in "Marco" Stores or receive other Privileges from the Operator, the Customer holding the Bonus Card must become a Member of the Program and register with the Program, including registration of the Card:
- By completing the Questionnaire and confirming its explicit, complete and unconditional acceptance of the Program Rules by the Participant signing in the relevant section of the Questionnaire. The Customer shall be considered a registered Participant of the "Marco" Program and shall be assigned a Point Account number upon completion of all actions provided in this paragraph.
3.5. Upon registration in the Program by one of the means provided by these Rules, the Participant shall give his consent:
3.5.1 process with and/or without automation tools all personal data specified by the Participant during registration in the Program, including in the Questionnaire, including collection, recording, systematization, accumulation, storage, clarification (Update, modify), retrieve, use, transmit, impersonate, block, delete, destroy of information about the Member 's purchases, their amount, methods and means of payment for the purpose of providing the Member with information (Advertising), including goods and/or services, promotions, personal offers that may potentially give interest to the Participant, as well as for the purpose of collecting, ensuring the granting of privileges provided by the Rules to the Participants, as well as processing statistical information and conducting marketing research, including with the possibility of commercial use of these studies results;
3.5.2 assign processing of all personal data specified by the Participant during registration in the Program, including in the Questionnaire to other persons in any way for the above-mentioned purposes.
3.6. Consent to processing of personal data in accordance with the above conditions shall be granted by the Participant for a period of 50 (Fifty) years. The consent provided to the Operator can be withdrawn by the Participant by means of the written statement to the Operator mailing to the address: 060000 Kazakhstan. Atyrau Region, Atyrau city, Baktygerey Kulmanov str., building 111A).
3.7. The Program Bonus Card is the property of the Operator and shall be returned by the Participant at the Operator 's first request.
3.8. If there were no cards in the store at the time of the purchase, the Operator reserves the right not to earn points to the Member 's Card at the presence of old checks. The Customer can get the Card at the cash register in the "Marco" Store on general terms and conditions which are being in force at the time of purchase of such Card in accordance with the Program Rules, the Customer shall register it in accordance with Clause 3.4. of these Regulations.
3.9 The Bonus Card is not subject to return by the Participant.
3.10 If the Card is not registered, in accordance with item 3.4. of the Rules, the Operator is not responsible for the safety of points on the Card and cannot perform full service. The Customer is not entitled to receive information about points on the Card if the has not been registered in accordance with Clause 3.4. of the Rules.
4. Points Earning:
4.1 Points shall be charged to the Participant 's Point Account when making purchases of goods and/or services from the Operator using the Card in accordance with the Program Rules, as well as if the Participants meet other conditions defined by the Operator independently or in agreement with the Partner, which are the basis for Points earning.
4.2 Points are charged for any payment method of goods and/or services performed by the Participant at the Operator: cash, credit card and other available methods.
4.3 Additional Points may be charged to Participants as part of the Operator 's promotions. The Operator may determine the list of goods/services and the number of additional Points charged to the Member 's Point Account when he/she purchases goods/services under the promotions.
4.4 The Participant shall present the Card before the moment of purchase payment (opening of cash check) to earn Points when making purchases of goods from the Operator in "Marco" Stores.
If the Member has not presented the Card, Points will not be charged.
4.5 The Operator shall independently create rules for Points/additional Points for purchases of goods and/or services in "Marco" Stores made using the Bonus Card. Points/Additional Points Rules are available on the Program Website.
4.6 Rules for Points, Extra Points when shopping in "Marco" Stores with Card presentation are available in the relevant section on the website www.marco.kz
4.7 Additional Points may be awarded to the Participant if the Operator takes part in promotions of "Marco" Stores. The number of such additional Points shall be determined at the Operator 's discretion.
Additional Points provided for in this Clause 4.7. of the Rules shall be charged to the Cards in excess of the basic accrual provided in Clause 4.6. Rules.
4.8. The document confirming the Operator 's obligation to charge Points to the Participant 's Point Account is a cash check confirming the fact of made purchase, including a non-fiscal report, with information on the date, amount, place of purchase, Card number. Appeals to the Operator on the fact that Points are not earned/incorrect number of Points are considered at presentation of the above document.
4.9. At commission of purchase of goods and/or services by the Participant from the Operator with use (write-off) of Points for receiving a discount, the Points are charged only for that part of purchase which was paid with money (cash or cash card) according to these rules.
4.10 Points are not charged when you purchase item or group of items defined by the Operator.
4.11 The Operator shall have unilateral right to make changes to the points system, determine the goods or groups of goods for which points may be charged, exclude the goods or groups of goods for which points are charged.
4.12 When making a purchase of goods and/or services in accordance with these Rules, the Participant shall independently make a decision to charge or write off the Points and inform the Operator 's cashier of his decision before closing the check.
4.13 Points and rights granted to a Member in connection with his participation in the Program may not be sold, transferred, assigned to another person or used except in accordance with these Rules. Points have no cash expression and cash value.
4.16 Points Earning Period:
- When you make purchases in "Marco" Stores with a Card, the Points will be charged to the Point Account on the date of such purchases.
5. Points Debit:
5.1 Points shall be charged to receive a discount when a Member makes purchases of goods and/or services or receives discounts by promotions, if the Card is presented to the Operator and the Customer shall be registered as a Member, including registration of the Card, in accordance with these Rules.
5.2 The Participant shall inform the cashier of the "Marco" Store about his wish to use the charged Points and the number of Points he wishes to charge when making a purchase before closing the cash check and Points previously charged shall be charged first.
5.3 The Points validation makes 6 (Six) calendar months unless otherwise specified on the Program website www.marco.kz The term specified in this clause shall be calculated from the date of Points, unless otherwise provided by these Rules. At the end of the specified period, the unused Points are automatically debited from the Member 's Point Account without the possibility of their restoration.
5.4 Points may be charged to receive discounts when the Participant makes purchases of promotional items, but no additional discounts are applied on this check.
5.5 The current legislation of the Republic of Kazakhstan, as well as the Operator may provide for other restrictions on use (debit) of the Points.
5.6 Up to 30% (thirty percent) of the value of such purchases, subject to the limitations set forth in these Rules and applicable laws of the Republic of Kazakhstan may be charged as Points to receive a discount when the Participant makes purchases of goods and/or services from the Operator and Partners.
6. Return of goods purchased using the Card:
6.1 Exchange and return of goods purchased using the Card is carried out in accordance with the current legislation of the Republic of Kazakhstan.
6.2 At returns of the goods/service refusal to the Operator by the Participant, the Points for such purchases shall not be charged to the Participant, and if they have been charged, they shall be cancelled (debited) from the Participant 's Point Account.
6.3 In case of return of the goods/service refusal by the Participant to the Operator, upon purchase of which the Points were debited from the Point account of the Participant in the form of discount for purchase in accordance with the Rules, the debited early amount of the Points shall be returned to the Participant on the date of the return of the goods/service refusal transaction.
7. Procedure of Card blocking in case of its loss/damage:
7.1 The Participant may obtain New Bonus Card to replace the lost one at the cash register at the "Marco" Store under the general conditions applicable at the time of purchase of such Card in accordance with the Program Rules and register it in accordance with Clause 3.4. of the Rules to the mobile phone number previously specified during registration in the Program. If the lost Bonus Card has not been blocked at the time of registration of the new Bonus Card for the mobile phone number previously specified at registration in the Program, the lost Card is automatically blocked after registration of the new Bonus Card.
7.2 The previously accumulated Points will be available for use within 7 (seven) calendar days, upon receipt of the new Bonus Card and its registration in accordance with these Rules, provided that the new Card is registered on the same mobile phone number as specified by the Participant upon registration of the lost Card. No more than 1 card can be issued per phone number for the entire period of participation in the program.
7.3 Points debited from the Member 's Account shall not be recovered by using the Card lost by the Member before the Card blocking .
8. Other terms and conditions:
8.1 The Participant shall be responsible for correctness and accuracy of personal data specified by him during registration in the Program.
8.2 The Program Rules may be changed unilaterally by the Operator at any time with mandatory publication of the changes on the Site. The Operator also has the right to additionally inform the Participants on changes of Rules by means of phone call and/or mailing the electronic message by e-mail or in different way, provided by Rules of the program.
8.3 The Participant is responsible for the security of the Card as well as unauthorized access of third parties to the Card. The Operator shall not be liable for unauthorized use of the Member 's Card by third parties.
8.4 The Operator may unilaterally at any time terminate participation in the Program of any Participant without notice for any reason, including but not limited to, if the Participant:
- Does not comply with these Regulations;
- Abuses any Privileges granted to the Participant under the Program;
- Provide inaccurate information or misleading information to the Operator;
- Does not use the Card in accordance with the Rules within 1 (one) year from the date of its receipt.
- Did not register the card within 30 calendar days from the moment of its acquisition.
8.5 The Participant shall have the right to terminate participation in the Program at any time by sending written notice of termination of participation to the Operator. Participation of the relevant Participant in the Program will be considered terminated from the moment of receipt of the Participant 's notification by the Operator.
8.6 The Participant undertakes to monitor the information about the Participant 's Score Account contained in the Personal Office independently, as well as the information specified on the additional check. If the Participant detects a discrepancy of information, it is necessary to inform the Program Contact Center.
8.7 In cases of termination of participation of the relevant Participant in the Program on the grounds stipulated in paragraph 8.4. and p.8.5. of these Rules, the Operator shall remove the Participant 's data from the Program information system and the previously accumulated Points shall be cancelled. Upon termination of Member 's membership in the Program, the Card shall terminate (the Card shall be blocked) and the Points held in the Point Account of the respective Member shall be automatically debited (cancelled). At the same time, the Participant shall not claim from the Operator any compensation of the written off (cancelled) Points including in cash form.
8.8 Having registered with the Program and having accepted the Regulations in accordance with the terms of Clause 3.4. of these Rules, the Participant agrees to receive the Notices provided for in these Rules from the Operator, but reserves the right to waive advertising notices in one of the following ways:
- In the Online account on the Program Site;
- By contacting the Contact Center.
8.9 The Operator shall have the right to suspend or terminate the Program unilaterally at any time by notifying the Participants by any available means not less than thirty (30) days prior to the date of suspension or termination of the Program. In case of suspension or termination of the Program, the Operator shall not compensate the Participants for the balance of Points held in the Points accounts of the Participants at the time of suspension or termination of the Program. The Participants shall not be entitled to demand any reimbursement of Points from the Operator, including in monetary form.
8.10 The rules of promotions held by the Operator in "Marco" Stores can be found on special sections of the Site.
8.11 The Operator shall carry out the Promotions within the Loyalty Program. The Operator shall announce the forthcoming Promotion, its terms, persons entitled to take part in it, the dates of its holding and other information about the Promotion by posting such information on the Program Website, by sending Notifications provided in these Rules. The Promotion may be changed by the Operator at its discretion, the terms and conditions of the Promotion may be changed at any time at the Operator 's discretion.
9. Program Dispute Resolution:
9.1 All disputes between the Operator and the Participant will be resolved by negotiation.
9.2 If the dispute between the Operator and the Participant cannot be settled during negotiations, it shall be resolved in accordance with the procedure stipulated by the current legislation of the Republic of Kazakhstan.
